Rent and Utilities: My Landlord Says I Haven't Paid Rent when I Did. Wants a Late Fee Now

My question involves landlord-tenant law in the State of: Minnesota



Hello everyone,



I moved into my apartment in May and rent is $890/month. I wrote them a check for the deposit ($890), and then wrote a separate check for $3560 - four months up front. After that I kept getting harassed every month with letters under my door threatenin eviction if I didn't pay. I would have to call a bunch of people before they realized that it was all clear. It has been very stressful. But they required four months down since I'm a student and also working and don't meet their minimum salary. After that mess was over it was October, and rent was due - I paid two months in advance again (probably shouldn't do that, now I realize) for October and November. The check was never cashed, but I never received any letters threatening eviction, court fees and all of that. I assumed that they took my check but were going to cash it in November for easier book keeping. Well November 3rd rolled around and I got a letter saying we're going to be evicted on Friday if we don't pay. I called four people and didn't get a reply, finally a text message to one person got through and they said "You paid Octobers rent through a money order but you did not pay Novembers yet." I sent them this message in reply "I paid with a personal check last month and wrote it for $1780 and put "rent for Oct/Nov." I still have my stub in my checkbook from it. It has not been cashed. If you guys have it down as me paying through a money order then I'm fine with paying this months rent plus $50 because that means I didn't pay last months rent and I'm saving $830. What I'm getting at is I don't want to rip anyone off. If you guys lost my check I'm fine with writing a new one but I'm not going to pay the late fee. I'm not trying to come off as rude or anything but I just want to solve this. The only money order we gave was for our dog for $215 for the pet deposit and rent, I have that receipt."



Basically it sounds like they lost my check. My next question is since she clearly stated that I paid rent and I clearly stated I did not, can I just write them a check for the $890 + $50 late fee for November? Because this is saving me $830 since I didn't actually pay Octobers rent. Now if I can't do that, then do I have to really pay a late fee this month if they were the ones who lost my check?

Finally can I take them to court for all the stress they've been putting me under? I have copies of everything including their many letters saying they're going to evict me when it was book keeping errors on their end.
