My question involves court procedures for the state of: Florida
I have recently filed a civil lawsuit. The Defendant knowing of such, is playing hide and seek. Having tried to serve on the most recent address via Law Enforcement days ago only to find a swift exit with no forwarding address, I'm left with the search once again.
Reading Florida Statute 48 I summarized that if according to the public record, the address on file which is with the Department of Business Regulation and continues to receive mail there, I can serve the address which in this case is the mother of the defendant.
(6) If the only address for a person to be served, which is discoverable through public records, is a private mailbox, substitute service may be made by leaving a copy of the process with the person in charge of the private mailbox, but only if the process server determines that the person to be served maintains a mailbox at that location.
Is this a viable means of the service process?
