Abandoned Property: Can I Donate My Ex's Furniture

samedi 14 février 2015

My question involves personal property located in the State of: California

Hi everyone, thanks for your help and knowledge in advance,

I've been researching but haven't gotten a clear response. About two years ago i moved in with a gf we both were on the lease, fast forward to last april 2014 we broke up and she moved out, she had left a desk, bookshelf, dresser and a few other miscellaneous belongings (blankets, dishes). Since the day she moved out to her mom's place i agreed to hold on to these things until she got her own place. November 2014 she let me know she had gotten her own place and was planning on picking up these items. It has been a constant battle with her to pick these things up. She says "ill be there on saturday to pick them up" and not a single reply to let me know plans have changed and is no longer able to pick them up (or is not in the mood to pick them up). This has been going on since November 2014 till today, Every other weekend. she says she still wants these things but seems to be playing games and wasting my time.

I am trying to get new furniture so her things are in the way, due to fear or prosecution i don't just want to throw these things away. Her name is no longer on the lease. Feb 1st 2015 i gave her both a Written AND verbal notice that if these things are not claimed i will be donating them to salvation army.

I'm i able to get rid of these things as stated above? will my written notice be valid if she chooses to take me to court? if not, what are my options for this? i really just want to put this behind me and move on.

thanks again in advance.
