Background Checks: Which State Law Applies Where

My question involves labor and employment law for the state of: Arizona



Background: 9 years ago I plead guilty to a criminal trespass in exchange for a deferred adjudication. After 18 months I paid the fine and completed the probation.



Fast forward to present: When I was living in the state of California I applied for a job out of state. The state of CA only allows for 7 years back. Now I'm living in AZ and have to do another background check, I am asked whether or not I have been convicted of any crimes. The state of Montana will not release adverse information (from what I understand) is older than 7 years period, but does that law apply to Montana records or are you only afforded that protection as an applicant in Montana? Is a deferred sentence (where the charges were later dismissed) even truly a conviction?
