Business Regulation: Pharmacy Website in USA

Hi there,



I'm a web designer. I've an issue with a client.



There is someone has a registered pharmacy located in a country somewhere abroad, not in the USA. According to his country's law, it is allowed to do online pharmacy and take orders online with mail delivery as long as he is selling non-prescription drugs according to his country's laws. He intends to sell the medications all anywhere except to the USA as it is not allowed for him by his country's law to ship medicines to the USA. Everything is legal according to his country, but the cost is very expensive.



He wants to host his website in an American company for better servers performance and lower cost.



As the best of my knowledge, the American law doesn't allow online pharmacies that is not registered in the USA. I contacted many American hosting providers. They said they don't mind to host his website as long as they don't receive any legal complaint regarding his website and as long as he doesn't infringe their terms.



Following are my questions:



1- Given the client won't trade in the USA, is it allowed to host in the USA?

2- Can he receive a complaint from any USA court regarding his website?

3- If a non USA court in another country, say Sweden, Japan, etc... send a complaint against him, Can the hosting provider terminate his website down?
