Co-Ownership: Partition Action for Real Property in Joint Tenancy

dimanche 22 février 2015

My question involves real estate located in the State of Minnesota. My sister and I own a home in Joint Tenancy. She filed a Partition Action. The court ordered that we use a mediator. We came to a mediated agreement to have me give her a deed upon receipt of payment. Nothing was mentioned during mediation regarding property taxes or who would prepare the documents. When I contacted her regarding the transaction, I was told that I would have to pay the property taxes before completing the transaction. Now she has motioned the court for a hearing. Does the court typically order the parties back into mediation or order that the partition action proceed?
