My question involves child support in the State of: Florida. My husband pays child support via income deduction in the State of Florida. He is not in arrears (almost paid one full month ahead because of the discrepancies we are dealing with).
He had one child emancipate from the order in 2014. At the time of the adjustment to the support, there was an "on paper" arrearage for a period of about 2 weeks while the different order was filed and sent to the various departments we have to deal with. This was because the DOR attorney pulled payment records several weeks prior to the hearing, and at the time of the hearing did not take into account 2 payments that had been sent in, despite him having print outs from the State's own website showing the payments! During that time, the Offset Coordinator's office garnished our income tax return. I, as the injured spouse, did not fight it because we were assured by the DOR that it would all sort itself out in a few weeks. ( I know...my mistake.)
His income deduction order was filed with the arrearage that, really did not exist, which is how he came to be paid so far ahead. Working on getting that sorted out now. Clerk of Court, and the DOR website show his support as being current. We contacted the Offset Coordinator's office and were told that the money would be held there for at least 6 months, while they determined how much to disperse. The Offset Coordinator's office is the only one who seems to think that there might still be an arrearage. No money has been sent to, or is due to, the custodial parent. We have made numerous phone calls, and sent letters and documentation, all to no avail.
Does anyone know how to get the various departments to all compare records and get this straightened out? We are reluctant to file our taxes for fear this is still all screwed up.
My husband has paid over $175,000 in CS, along with alimony, and insurance/health expenses. He is certainly NO deadbeat Dad! It would just really be nice if the State could get it's act together!
