My question involves a consumer law issue in the State of: California
Hi,
I purchased a truck in December of 2013. My fiancé failed to make 2 payments they were late and it was repossess in July of 2014. We got the truck back and have been making the payments.
Yesterday February 19, 2015 we go outside and the truck is gone. Knowing the payments are up to date we first thought it was stolen. After calling nationwide and them agreeing we were not late on payments I was notified that there had been a mistake through the repo department and they had realized this mistake and were suppose to put a hold on the repo to stop it, but they never did this or didn't do it fast enough because the truck was taken.
My fiancé who is the driver of the truck as I am disabled and don't drive much had to miss work yesterday because of this and then miss work again today because the repossession company said they didn't have any appointments available for us to come pick up our truck. Not only has he had to miss 2 days of work, we had to go to the sherif department and pay to get the vehicle repo release, we also have to drive over 40 minutes to go pick up the truck. This has been extremely stressful for me. They agreed to reimburse for the missed work and vehicle repo relase, but this is not fair they stole the truck we are current on payments and they didn't even bring the truck back to us we had to jump through these hoops to get it back ourselves.
What legal right do we have in the state of California? Do we have the right to sue for the remaining balance of the truck? What compensation is appropriate?
Thank you
