My question involves a child custody case from the State of: California
My dad passed away two weeks ago leaving behind my half brother who is 5. My dad and the child's mother divorced over a year ago and she gave up custody and left the state. She has not had contact with the child since she left. My dad spoke with a lawyer and let it be known that she was unfit, this is the second child she had abandoned and he wanted his niece to raise the child. What rights does this mother have? How hard would it be for her to regain custody of him? What rights do her parents have or me as his oldest sibling? I am 37. She lives with a very ill elderly father, doesn't have a job, spends most of her time in and out of jail and is a habitual drug user.
Her mother (child's grandmother) has assured the family that she is fine with my dad's wishes.
