My question involves a child custody case from the State of: Texas
The father of my toddler was arrested back in April of 2013 and charged with family violence against me. I moved to another county with family. In November of 2013 we went to court for child support/ visitation. There was no hearing. He was ordered supervised visitation in a public setting. The family I was staying with at the time offered little to no support in my situation. I didn't have a vehicle to meet him half way and none of my family wanted to supervise the visitation leaving me to let his mother supervise the visitation she of course didn't do it publicly but in her home. Eventually my family pushed me to go back and due to my situation and his constant harassment and promises to change I took him back.
We moved in together in March 2014 after awhile he began to be abusive and controlling again. During that time he didn't establish a bond with our son and even lost his temper with the children and myself. In July I called the cops because he lost his temper with my oldest son (5) who is not his biological son. After I stuck up for my son he ended up getting physical. He was arrested a couple days later. EPO was put in place and after that he was put under bond conditions that ordered him to stay away from me and not text or call. He violated the bond and I testified and showed proof he did so. His lawyer implied I only did this because of a custody case. The judge disregarded it because she felt that was a civil matter. He was ordered to take a drug test and failed it. Still the judge let him out on conditions.
Now that I'm aware his attorney also practices family law I'm concerned for my son. I quit letting my ex's mother supervise the visits out of concern for my son's well being. He has called cps on me accusing me of neglect and drug use . The drug test came back negative and they closed the case.
We still have to go to trial for this second family violence charge. At this moment I'm unemployed and need legal help. His mother is obviously helping him pay for his lawyers. I'm wondering if a legal aid lawyer will be just as good in helping me establish a new court order. I need to know my son is safe and although I'm technically not abiding by the original court order I know it's for my child's best interest. I honestly feel like he Is using our son against me and is not genuine in establishing a bond with him. Also according to the court order he is not to come to my residence but still sends his step father every other Sunday when it clearly states visitation should be done in a public place. Also can I ask the judge to have the father mentally evaluated? When I was living with him he went to mhmr after losing his temper with my oldest son. He never followed through and got diagnosed and on his meds. I know he has to have a mental problem. I apologize for the long story but appreciate any feedback

Custody and Visitation Issues: History of Family Violence on Father of Child. Need Legal Advice Due to Circumstances
