My question involves a marriage in the state of: Texas
Hello, please bare with me for this will be quite long.
In 2006, my grandmothers house burned down. She was able to rent at the time until certain things were done. She received insurance money, while the rest of her family was trying to get her to hold onto it, get an apartment for a while or stay in TN where my mom resided at the time, until she knew what she wanted to do for housing. My uncle and his wife talked her into building a small , one bedroom house in the back of his 2 acre property. My grandmother worked also, so she took his offer and built a small place on his property in 2008. Little did she know that they were having marital issues at the time. Jumping to June of 2013, my uncle moved out of his wife's house - while my grandmother lived on their property still. My grandmother has paid parts of the property taxes and her share of the utility bills, and after my Uncle moved out of the house, my mom and I found out while going over all the credit card debt bills that she has saved, trying to figure out why she was so in debt - we found that my uncle and his wife put my grandmother in over 40k worth of credit card debt. Of course my grandmother blames herself for this, due to the fact that she trusted her son and thought that he would start paying her for the credit he used on her accounts.
Now her son and her soon to be ex-daughter in law are fighting over the property, etc. My uncles wife has no communication with my grandmother, she leaves her mail on the back porch for my mother to pick up, and my mother has been staying with my grandmother cause my grandmother can no longer work due to her health. My Uncles soon to be ex-wife writes down their half of what they owe for the utility bills, property taxes, etc and my mother pays their share ( hers and my grandmothers). My Aunt is fighting to keep the property, and I was really hoping that my grandmother would come out at least with a buyout, or something to make this right. I'm not sure what the laws are for this, or if my aunt could make my grandmother move off her property if the judge grants her the property in the divorce. My uncle isn't doing a very good job with protecting his mother in this. There was nothing signed legally when she built her house on their property, nothing but good faith in her son. Is there anything that can be done to protect my grandmother in all of this, or is she just out of luck due to mistrust?
