My question involves a marriage in the state of:trying to get a quick mutual consent divorce.
My wife and I were married in China. We have been living the US as married couple for over 10 years and have a child born here. Things fell apart recently and we are looking for a quick divorce. However, VA law requires to establish a legal separation of 12 months before filing a divorce. It is rather long and we want to make the impact on our kid as low as possible by continuing living together under the same roof and making it at least appear as a complete family to my child. Can we just file divorce in China and establish division of child custody and assets in a contractual document? What are the legal implications and potential risks with this approach? Another issue I am not clear about is the implication of custody if one of us want to move to another state or abroad. If I have obtained full custody, do I still need my wife's approval to move abroad?
