Moving Out: Moving Out and Roommate Locks Me Out Before I Can Get All My Stuff (Nyc)

My question involves landlord-tenant law in the State of: New York (NYC)



So I'm asking this question on behalf of a friend/new roommate.



So I have this new roommate who just moved in and he is having trouble getting his stuff from the place he just moved out of. He lived in the place more than 30 days but never signed any lease so he has few options to prove how long he lived there. He still has a key to the apartment but his old roommate is now locking a secondary "deadbolt" lock that was never used before. His old roommate is apparently possessive and did not want him moving out so he is now holding his stuff hostage. There are hundreds of text messages over the last week between the two which has the former roommate admitting the following facts.



1. That he did in fact live there.

2. That he was in the process of moving out.

3. That he has his stuff.

4. A claim that he moved his stuff out of the apartment and into a near by storage unit (i think this is illegal, not sure)

5. Several agreements to allow him to come get his stuff at certain times, each time the former roommate changes his mind at the last minute.

6. Lots of name calling, threats to destroy his stuff, invites on dates or to move back in. (they guy seems crazy)



So the question is this, what is the bast way to handle this? My new roommate is a college student, new to New York, and doesnt have money to hire a lawyer and spend countless time in court. Should he just call the police and file a report of theft? Can he legally break into the apartment while the guy is at work? Any advice would be very helpful.
