Hi, I went and spoke with an immigration attorney that wanted to see me pro-bono, we offered to pay her but she insisted that she did not want payment, but when I sat down with her after signing some paperwork she gave me she stated we had established "attorney client privilege" I then allowed a few guests I had to sit in on the consultation. While I am grateful for the time, I got the worst and most devastating legal advice from this woman. The situation is that my U.S. citizen (I believe from birth through her father, as she owns a passport and has never taken a citizenship exam) brought me to this country with her from Canada at the age of 3 on a bus, I have been living here ever since.
The lawyer sat down with us and told me that since I was under 21 I was covered by the "Child Status Protection Act" and was eligible for a green card as an immediate relative with no wait time whatsoever. She then proceeded to tell me that I had to have a medical exam, vaccinations done (which I paid for), and the documentation postmarked and sent in by the 30th of January..(the 31st being my 21st), there were at least 3 other people in the room at the time besides me.
I followed her directions and got everything done, and sent off (postmarked) on the 30th just as she had told me, my I-130 was accepted and I-485 rejected stating a priority date had not been established. I contacted the lawyer about it and she stated "of course because they received it the 2nd of february", as if she did NOT tell me that as soon as it was postmarked the date was frozen. If she would've told me that two weeks prior when I had seen her I would have rushed the process significantly, and I wouldn't be in illegal status currently and waiting in what she says is an "8 year line!!!:wallbang:" as you can understand I'm quite furious. This is devastating to me, and could potentially rip me away from my U.S. citizen mother and siblings, and U.S. citizen fiancee. What am I supposed to do? Why should I have to go back to a country that is basically foreign to me? It's hard enough trying to get established in the country you're in! I feel so much frustration and really wish I would've seen another attorney, it's crazy that basically 2 words from this attorney screwed me, I asked for re-assurance and she got all uppity saying "Yeah I'm sure!" well apparently she was a little TOO sure of herself..smh
I don't necessarily care about the money lost in this, it was $400 maybe, but I do NOT want to allow her the ability to do this to someone else. Is there anything I can do??
