My question involves a traffic ticket from the state of: Mississippi
Quick debate question for a first post.. One Saturday night late January I was driving a new Toyota Truck fully legal to the T. Well, I missed my turn on the State 4- lane highway so I took an off ramp and pulled into a parking lot to turn around. The ground was frosted over and the drive appeared to be an entrance in and separate exit out like the park lot next to it. I got the front wheels where I thought was the drive and felt it was grass, not asphalt. I immediately stopped and reversed and proceeded normally out of the one entrance/exit. Once I got back on the Hwy a local patrol car pulled me over almost instantly. The young officer asked how much I had to drink and I told him nothing. He then asked me to pull to the side of the road further than I already was. He then asked again how much I had had to drink. I am prior Law Enf.and asked him what his PC was ..He said " ummm you pulled off in the grass in that parking lot over there " I requested to see a PBT and blow since I knew I was good. So I did that , and then he stated my Driver's License was suspended when he checked them there at the stop. Rather than be a curbside Attorney I went along with it and went to jail to bond out. After paying the guarantee percentage to bond out . I called a friend to pick me up, and carry me to my house about half an hour away. The suspension turned out to be from a reinstatement fee that had been paid two years earlier and never entered in the MDPS Dispatch CAD. I can take that to court, but my question is was the stop a reasonable stop considering the parking lot in question was frosted over to blend to the grass, and this was private property where he observed me doing this allegedly. I did in fact make a corrective action to rectify going in the grass rather than just keep going straight through. I am prior Law Enf., patrolman at that, and this has got me and my buddies stumped..we even brought up with the population of 3300, if the patrol had jurisdiction to patrol from the state highway.. So would be grateful to get thoughts on this. I would like to be able to tell Judge the reasonable suspicion of a crime being committed is a far shot for the stop and therefore pray for relief of dismissal.
