Relocation: Is It Illegal for the Mother in a Situation of Joint Custody to Up and Move

My question involves a child custody case from the State of: New York.



My husband has a 3 year old daughter from a previous relationship whom he shares joint custody of. The mother of the child has primary residence, and my husband has her every Wednesday and Thursday, and also every other weekend.

This past Tuesday, my husband received a text message from his child's mother informing him that he would not be getting her Wednesday Through Sunday/Monday for his weekend because she had gone on "vacation" to Florida with the child. Since she was already in Florida, there wasn't much he could do so he basically just had to say "okay".

Well, today he received another text message from her stating, and I quote: "btdubs, moved to Florida.." (Btdubs means "by the way")



He has filed a petition already, but my question is, will this get him anywhere? Will she get in trouble for doing this? I am so worried that he will just get screwed over and not be able to see his daughter again, at least for a while. I just held him as he cried about an hour ago and I swear I could just feel his heart breaking :( He is such a good father, and I feel so bad for him.

Any advice, especially related experiences, would be greatly appreciated!
