Seller Disclosure: Denying to Accept the Demand Letter As Builder's Construction is Suspended

My question involves real estate located in the State of: Maharashtra, India - Pune.



Hi,

I have bought the property with well-known builder in Pune.

I was never informed by the sales team that the property is pending for environment clearance certificate.

Only after the agreement, I realize that property is waiting for the environment clearance.

The construction at the site is stopped based on the government orders. This is going to cause delay in possession.

I have paid my own contribution to the builder and I am about to avail the bank loan.

Builder has already issued me demand letter and have asked for further payment and also informed that delay to it after 7 days would cause the 18% interest as per our agreement which I have signed.

I am worried and I don’t want to pay unless I see the construction is started.



How can I notify the builder that I want to delay the payment till project is issued environment clearance?

Also can builder actually charge the interest on delayed payment while government notice to stop the work is active.

He said I will have to pay the interest at the possession time. Can he do it without informing me prior ?
