Speeding Tickets: What to Do for Second Offense Speeding Ticket

dimanche 22 février 2015

My question involves a traffic ticket from the state of: California

So I had previously gotten a speeding ticket for going about 10 or 12 over the speed limit back around 12-10 months ago. I went ahead and paid the ticket and went to driving school so I could avoid any points on my record.

Now I have a second ticket that says I was going about 20 over the speed limit. 91 mph in 70 mph?

Here is where I'm conflicted.

The highway I was on was pitch black Bc were no hwy lights and it was getting foggy so I could not see any indication of what the speed limit was. Frankly, I didn't know if I was going down the right road, I just put my faith in my gps. I didn't feel safe stopping anywhere.

As I felt my car going downhill, I started to press on my brakes. My car started making a hazard noise so I started getting scared but kept pressing on the breaks.

Before I could press on even more to slow down further, a CHP officer pulled me over and asked me if I knew how fast I was going. Obviously i knew I was going too fast and I tried to say I was trying to break since I had managed to get to 80mph by the time the officer was following me but I got a ticket sayin I was going 91 in a 70 never the less.

The county I got the ticket in is about 4 hours away from where I live. (I live in sacramento and was on my way to see my parents in Los Angeles)

I really don't want points on my record nor do I want to go to court.

What can I do?

Even if I were to appeal, would my situation be enough to get my ticket dismissed?
