My question involves a child custody case from the State of: CA
CURRENT: Parents have custody exchange every Tuesday after school and live within 3 miles of each other and child's high school.
BACKGROUND: As a result of a court ordered psychological evaluation mother received 70% custody of their then 14 yo son (father attempted suicide). Last year mother agreed to 50/50 custody after continued requests from father and child. Divorce is finalized and no hearings are currently pending.
ISSUE #1: Son called mother for a ride to father's house after school during father's custodial time while father was at work.
Is there any law preventing mother from transporting child to father's home during non-custodial time?
Does father have a case against mother for providing transportation?
Father was very angry with the child and they argued repeatedly about the ride home given by mother. The arguments escalated into issue #2.
ISSUE #2: Father told son to go live with mother for being "disrespectful" and for being a "liar", that the child may not enter father's apartment or father will call the police. This was said both verbally and by text to the child's cell phone. Child no longer wants to speak to father and is staying with mother during father's custodial time. Can father deny the child access to his home?
Can father deny access to pick up child's belongings that mother paid for?
Should mother proceed with any notification to court about the situation? If so, what type?
