Defamation: Was This Actionable

samedi 6 septembre 2014

My question involves defamation in the state of: Alabama

I know that this issue is probably no longer actionable due to the statutes of limitations, but I'm curious as to whether it was actionable within the limitations.

I own and operate a website in the car enthusiast vertical in North Alabama. I generate revenue from advertisers that want to target the local car enthusiasts that frequent my site.

On another local forum (my site also has a forum), a particular user painted my business skills in a negative light by stating mistruths about why I closed an auto parts distributor franchise I had at the time. Because of this, a potential advertiser I was talking with (who also frequents this particular forum) stopped talking with me and did not consider advertising anymore. The individual, who posted with their real first and last name and who I've met a few times in person, through their defamatory remarks on a public forum (I can link to the discussion for further research if needed) caused me to lose revenue. Was this actionable? Was it financially feasible to be actionable?

Thank you in advance for any replies.
