My question involves labor and employment law for the state of: ohio. A small family medical transport company wrote up a billing clerk for not sitting on her chair correctly. Evidently a manager saw this clerk sitting on a chair with one leg under neath her and the other on the floor. The manager admitted she had OCD and it bothered her when people sat like that. The next day the clerk was again shifting amoung various seating positions and a diffent employee saw the clerk sitting on her leg and took it upon herself to issue a 3 day suspension for merely sitting in a chair in a manner someone else didn't like. Does the clerk have any recourse here? Is the company in violation of the clerks rights in any way?
