My question involves collection proceedings in the State of: New York

Retiree Monthly Medical Insurance Past Due Premiums

I retired on September 28, 2012. My monthly medical premiums were (Approx. $800/Month) to be deducted from my monthly pension check by my employer and the balance of my pension was electronically deposited into my personal checking account. The benefits department of my company asked me pay the first two months of medical premiums by personal check, which I did, while the electronic funds transfer was being set up for my monthly pension check (less deductions). On June 16, 2014 I received a letter from my companies benefits department, informing me that my medical premiums dating back to October 2012 were never deducted from my pension checks. This represented 20 months of premiums past due (totaling over $17,000.00). The error was on the companies part. They want to now start my paying back the past due amount. I responded to the companies first letter and was able to show proof of my paying by my personal check the first two months premiums (which they had no record of). They accepted my proof of two months payment, and revised past due to 18 monthly premiums past due (approx. $16,000+ dollars) to be paid back over the next two years, beginning on September 2014.

I have friends who have suggested that there is a legislative law or regulation that if it applies to my case, the company may not be able to collect all and/or some part of the past premiums due.

Does anyone know of such a "Law" and what kind of lawyer would I look for that has experience with medical insurance premiums regulations.
