Police Conduct: Major Employee Theft, and Police Will Not Allow Me to Report Items As Stolen

My question involves police conduct in the State of: Indiana

I had an employee that worked for me for about 1.5 years. A few months ago I fired the employee for stealing from the store. I spent the first weekend (had to close the store for three days, and pay major overtime, plus about $6,000 in lost sales) attempting to figure out how much he had stolen, and figured an estimate to be $38,000 or more in product. I contacted his attorney and offered them a settlement if $50,000 since I knew I could sue for triple damages.



I thought I was doing the right thing, and giving him a second chance. Pay me back what you stole, or go to jail for 10-20 years. He is young, and just starting a family. If it all goes to court he would have to pay it back in restitution anyway.. So why not skip jail for up to 20 years, and just pay for what you stole?



Several weeks go by and I don't get a response. So I file charges with the local police. After filing the charges I get contacted by the police saying the clients attorney says I am trying to extort him, however they will still go after him.



I have the serial numbers of about a third of the stolen product, and the police refuse to let me file a stolen items report on the items in question. I want them listed on NCIC, but they will not do it.



I have been told that the PA has the report, and they are working on it. Well it's now been about eight weeks (twelve total, after giving them time on settlement) and the case seems to be stalled out.



I find it extremely strange that the police will not allow me to file the items as stolen. I also think it's a bit odd that it's taking so long.



Shouldn't I be able to report the items as stolen?



How to I contact someone hire up to find out why they are offering me little to no help? Internal affairs or something like that.



Also on a side note, members of his family are extremely well know/respected in the area and a lot higher in the pecking order than me. Rumors that I was told is his dad is also friends with a lot of the police department.



If I have to spend $15,000 getting any attorney, instead of going after the thief, I will just go after the city. I don't feel I should have to hire an attorney to get the police to do there jobs.
