Premises Liability: Is a Property Owner Liable for Injuries from an ATV Accident

My question involves an injury that occurred in the state of: TX



I experienced a traumatic brain injury over 3 years ago. I was evaluated by a neuropsychologist and received my results today. The testing revealed that I am significantly impaired from the accident(memory, processing, motor skills, etc). I'm currently unable to work and my hopes of returning to school are pretty low. I have struggled with the effects of this injury for some time but have just recently become insured and able to see doctors again.



The TBI occurred while using an ATV on a (family friend's) property. It was my first time on an ATV, he was present, the ATV belonged to him, and no helmets were available. I was not taken to the ER for my injuries(including the concussion). I believe he discouraged family from bringing me.



I am not trying to place blame on anyone but myself for my injuries. I am, however, desperate to have the care I need to make as much improvement with my cognitive abilities as possible. I am unable to work, have not yet applied for SSDI(beginning process), unable to work towards a degree, and so on. I am losing the financial support I have had since the accident.



The (family friend) who owned the property at the time has since sold the property.



Am I in any position to take legal action?
