Traffic Accidents: What to Expect from an Accident

vendredi 19 septembre 2014

My question involves an injury that occurred in the state of: Ohio

Thank you for taking the time to read this and giving some thoughts on the matter.

In 2011, I was at a stop light when I was rear-ended. I am a little fuzzy about that day but remember the lady coming to my truck and apologizing for hitting me and stating that she should not have been driving because she had no brakes but had to get her child to the doctor. I was working at the time and was in a work truck that sustained about $18,000 in damage which her insurance paid for. I did go to the hospital with a mild concussion and severe back pain. I had a week off of work and during that time went to a chiropractor (that did not help). I had been working for this same company for over ten years and a month prior to the accident had ventured out to start my own business. I had expected to work for this company until the end of the month and devote my entire time to my business. Anyways, I was not able to do both jobs and could hardly do the job I had been hurt at without help. After a few weeks, I was having trouble with my bladder and movement in my left leg and went to see a orthopedic doctor who had ordered x-rays and MRI. They had come back with herniated disks in my neck and a thoracic herniation that was compressing my spinal cord.

I am somewhat thankful that I do have workers comp to pay some of my bills but it is tough. I am being sued by some creditors and am behind on others slowly....falling behind. I did hire a lawyer and filed a suit against the other party before the two year statute was up and he took it out of the court which I guess preserves my right to sue for up to a year. We had sent over the demand letter asking for policy limits in June and the deadline to refile the suit is this October, we have not heard anything back from the insurance company.

Just extra information; I am a single father of a 14 yo boy. I did pay taxes on the earnings from the business which grossed $900/week with expected growth of 3 times that in 6 months. I had started to reroof my house two days prior to the accident (supposed to have the week off but was called in to do half day work)so, the roof was left open while it rained for three days. I was making $520/week at the job I had been hurt at. I was taken off of all work with permanent restrictions: sit for 2-3 hours with break, stand for 2-3 hours with break and 30 pound weight limit. I am in pain management and will be for the rest of my life. I do not go out much anymore. I feel my son is embarrassed to be seen with someone who can't walk very well and needs a cane, piss in pants and in constant pain. I was supposed to have surgery but wanted a few more opinions (which all suggested surgery). I had tried epidurals (7 times) and am going to try a spinal cord stimulator in the next few months. I just feel like I have been in a doctors waiting room for the past three years reading the same magazines....waiting.

My apologies if any of this is incoherent, I will try to clarify anything you need.

My question is: What can I REALLY reasonably expect from all this?

Thanks
