The HOA of my neighborhood recently (as of yesterday 16 September 2014) widen an asphalt path that is next to my property and is now encroaching on my property. No survey was done by the contractor, H&M Paving, and in addition, new raised asphalt path will now cause water runoff and drainage problems on my property. What are my legal rights in Fairfax County, Virginia and what legal recourse should I pursue. The Walney Glen HOA has had a repeated reputation of overstepping its authority.
