My question involves a traffic ticket from the state of: California. I was given a citation for a minor speeding ticket, had forgotten my wallet, so the citation included driving without a license. I told the officer I left my wallet at home and he said no problem, I can look it up. He said the citation was not serious. I went online and paid the fine. The two citations were lumped together. There was nothing about any of this to indicate this was anything more than a simple traffic ticket. But in a background check later on I found out that I was in fact convicted of a misdemeanor for driving without a VALID license, not just not having a license with me. It never crossed my mind that that was in the picture. I cannot find out any information that helps me figure out how to even begin the process of addressing this mistake. I've been told to file "dismissal" forms, but those are for people who committed a crime, were convicted because they were guilty, received a sentence or probation, and now want their records to look better. That is not my situation. And since there was no court appearance, I have nothing prior to refer to so I can't appeal anything or refer to a case. One attorney was just so shocked that misdemeanors could happen when you agree to pay a fine online that he had nothing to say but that I should let the DA know that this was going on and he should know about it. I was essentially convicted of a misdemeanor without a court appearance, a clear presentation of the charges, opportunity for representation, notification of the outcome, and information about what to do if I disagreed. No due process it would seem. Is that actually legal?
