The information below was sprung on citizen's at the last town council meeting. So many people don't understand exactly what's going on. The railroad company referenced, has caused total havoc in the next town over and citizen's are nervous about them coming to our town.
OUR TOWN
Following a 30 minute executive session, Council unanimously approved first reading on the closure of a portion of Blue Street and conveyance to abutting landowners.
The ordinance states that the town abandons and closes all of Blue Street except for the section that was formerly known as Long Street and runs between property owned by the John Doe and Mary Smith.
Blue Street is a U-shaped street which goes around the old post office building and another building just off Purple St. and between the buildings and a recently constructed rail hub distribution area.
According to the ordinance, the closing of the street will enhance the opportunity for development and potential tax revenues and less road maintenance for the town.
The abandonment allows the property to be quitclaimed equally to the abutting landowners.
PROBLEMS IN THE NEXT TOWN OVER:
The railroad requested to close Red Drive, citizen's opposed, as it limited access to many homes. Instead of following procedure the railroad chose not to pursue the actual judicial closing, and blocked the crossing with an earthen berm. Area residents hired a lawyer and the case went to court.
According to a source familiar with the negotiations, the railroad is in agreement, having negotiated a significantly reduced amount citing the alleged issues with the way the original vote by Council was handled. The area residents, who are represented by attorney, must now decide whether to accept the settlement or not.
OUR QUESTIONS:
This is the same railroad company that took over Red St in the next town over without judicial permission.
The railroad didn't even tell our town they were setting up a rail hub distribution area on Blue St. Only after a town councilman visited the sight was it learned what they were doing. Three three weeks later the Town Council announces their plans to abandon the street. They railroad company is off loading heavy equipment and offer a customization turnkey solution for heavy machinery manufacturers and dealers to move their equipment door to door from origin point of import/manufacture in the Southeastern to destination point of export/domestic distribution anywhere on the North American rail network. The land is zoned for office use and is right beside a subdivision.
The "Supposed" Advantages:
1.) The closing of the street will enhance the opportunity for development.
There's no room in this area for anyone to develop or grow other than the railroad.
2.) Enhance the opportunity for development and potential tax revenues. Potential - having or showing the capacity to become or develop into something in the future.
So basically the town MIGHT make a little money, maybe they won't. The railroad company WILL NOT be the new owner of record for the "abandoned road" and therefore no taxes will be paid. If the railroad wants this road, why not sell them the road (property)? The railroad will be the new owner of record and have to pay taxes on it.
3.) Less road maintenance for the town. The town is not going to fix and maintain that road whether they abandon it or not.
