My question involves adoption law for the State of: West Virginia
I have been married to my husband for almost 3 years now and we've been talking for a while about him adopting my 4 year old son but the problem is his real father. He is behind in child support over $3000 and only comes to see his son when it is a "good" time for him which is anywhere from every 6 months to a year. As of now he hasn't came to see his son since June of this year. He doesn't help me with anything for my son and I have seen police reports about how he has been pulled over and they have thought he was on something which his now ex girlfriend had wrote me before and told me he was on drugs yet again. He also has a warrant for his arrest right now for not paying child support. My question is how would my husband be able to adopt my son? I know his father won't agree to it even though he half the time doesn't want anything to do with him and doesn't pay his child support.
