Business Disputes: Proving I Was a Partner/Owner Not Just an Employee

My question involves business law in the state of: Indiana



I started a business with a friend several months ago, I didn't have the credit and neither did he, but his wife did. We agreed orally that we were partners, but we had to use his wife's credit to get the business started, we put the LLC in her name along with the loans and the vehicles. Everything was fine, but he got mad at me and had me arrested for theft, stating that I wasn't a partner I was just a friend volunteering my help and my wives and my sons. Unfortunately I had no written statement stating that I was his partner. There was a utility in my wives name, a statement from the landlord of the building stating that my wife and I were renting the building to the utility company (the landlord now says he made a mistake), my wife went to classes with my partner and created a business plan, she set up several contracts with vendors herself, we have text messages of me sending him the new name of the business and him agreeing to it. Ninety percent of the tools, desks, computers and etc belonged to me, my son and wife. We worked day and night for 6 months at this business and then were left with nothing, we got our stff back but I am still being prosecuted. He never paid us for any of the time we worked. How can I prove that I was a partner and not just a volunteer, that I had as much right to the wrecker as he did? I even have a statement from a neighbor that I drove the wrecker as a personal vehicle constantly at my house. He made threats to me and my family and we left state to protect them. My hearing is in February.
