Enforcing Custody Orders: Time Sensitive Question Regarding Visitation

mercredi 17 décembre 2014

My question involves a child custody case from the State of: Mississippi

Thank you for reading this issue that is plaguing my girlfriend.

Mother has physical custody. Father has weekday daily visitation from 3pm to 6:pm, every other weekend, and alternating holidays.

Mother planned a drive to trip to Disney for the weekend with her 5 year old son. Weeks ago, father was informed and agreed to forgo his three hours on that Friday (via text), so the child and mother could leave in the early afternoon, rather than drive through the night (8 hour drive). Two days before the trip, father decided it is in the "best interest of the child" if he sees him for his regularly scheduled three hours and mother and son drive through the night. He said the only way he would reconsider is if she agreed to give up her Christmas with the child (it's her year, he had Xmas last year).

The divorce papers specifically state that the daily visitations should not interfere with any pre-scheduled activities. Does this trip fall under that category? Father threatened to call the police and charge her with kidnapping if she does not deliver him for the three hours.

Thanks again for reading and I look forward to your insight.
