Establishing an Order: Getting Mid-Week, Overnight Visitation

mardi 2 décembre 2014

My question involves a child custody case from the State of: California

I am a father of 2 adorable girls, and I live in the State of California.

I am going through a divorce and will have a hearing very soon. I am, like many other fathers and mothers, exhausted, emotionally drained, sad, but have never lost love, confidence, or desire to be in my daughters' lives.

I filed to divorce my wife.

This is what I want:

I drop off my 2 children at their school at 8:30AM on both Mondays and Tuesdays. I would be picking up the girls from their mother's home on Monday and Tuesday evening at 7PM. They would have dinner with me and sleep at my house on those 2 nights.

I would also have them every other weekend.

Looking at it, their mother and I would essentially be sharing the only 2 days of the week I have the girls, which is fine by me. This limits the time the girls would spend in day care whilst maximizing time spent with both their parents.

Wife wants me to see children only every other weekend. This would devastate me. I have spent a whole year volunteering at their kindergarten and I do many activities with them. I have never sought to limit their time with their mother, but their mother in my opinion seems to want to do just that.

I am so worried as I have no idea what happens in court....I have never been married before. Under what circumstances would a judge only allow me to see the children every other weekend?

I have been to attorneys and I am practically broke. I am not looking for anything except to have the children from 7PM until morning on Mondays and Tuesdays + every other weekend. What would a judge say? I don't drink, do drugs, and have been active in my children's lives.
