My question involves criminal law for the state of: Florida
I was involved in an incident in late 2013 in Florida, I was in an auto accident, while the other party hit my vehicle I was driving without a license and had knowledge of this, I had been stopped in the same city a few months back when I was UNAWARE of the license being suspended (it was not a Florida license) and I was given a ticket which I paid. During the accident I snapped and fled the scene, not the smartest thing in such a small town.
A couple days later the cops caught up with me and after speaking with a lawyer I agreed to have the cops come to my house and issue me the proper summons, (but no arrest was to take place)
I took my charges and the officer was very nice. It took a couple months to work everything out but in that time I got my license fully reinstated and cleared up any fines in my state, when I finally did go to court I was given probation and 100 hours community service.
The charges were held as stet (which meant no conviction) and started my probation, the issue was I could either pay my probation fee by continuing to work full time or quit my job be homeless and do community service, but not both!
After about a month of this I attempted to inform my probation officer of this, I left a letter at her office and told her to call me, which she did and left a voicemail and then my phone broke, shortly after this I switched carriers and the message was destroyed without me ever hearing it,
Not long after a friend who I considered family asked me to move to California, which I did to help him as a nanny for their new child, I spent 6 months in that community (I was only asked for my active license once and the cop showed no interest in anything on my record)
Sometime between California and the state I am currently in the small town in Florida finally issued a warrant for my arrest (it shows as a failure to appear/violation of probation) which I am guessing is a result of me not finishing my probation term properly.
I have been pulled over once in this state and they ran my license and informed me of the warrant which I already knew about, he chuckled and said the paperwork would be way to much so he wasn’t going to bother with me, but that when I went back to Florida I would be caught, which I told him I already knew.
My home state does not care about the warrant and it’s not enough for me to lose my driving privileges, however I am getting ready to go back to Florida,
My plans are to get to the town and get settled in then go turn myself in to the local police department, on my terms. I know I will be jailed and will be there until they wish to conduct a hearing.
The charges they will be bringing against me are:
Count 1: driving without a license with knowledge
Count 2: Leaving the scene of an accident with damage
Count 3: I forgot count 3 dammit
ALL COUNTS are misdemeanor under Florida law and even if given the full sentence for each count it equals no more than 60 days each count (total of 6 months in jail) and then my record should be clear,
I have no intention of hiding the fact I skipped out, I know what I did was wrong, I read somewhere that you can bring reason for leaving the state to the court, I have to find the case law but it mentioned family circumstances and if I got a letter from the family it may help my final sentence, according to the online system my warrant was issued
Issued: 12/30/2013
Bond Amount: $2000
It will be over a year since the warrant was issued when i finally return!
Also in the warrant they have no photo of me, no height or weight and a very generic description, i could literally walk by a cop with a warrant sheet and he would never know it was me!
I know this was a lot, but I hope that someone here can help me get an idea of what I may face when I return, I do not fear jail in this Community, nor do I think the cops would be vengeful for me leaving town!
I know the final question is going to be why I didn’t return sooner, it simply was not possible, when my 6 months in California were done I started making my way back, but it has been a slow process!
