Security Deposits: Getting a Deposit Back After Moving Out

My question involves landlord-tenant law in the State of: MA



Hi Folks!



Second time poster here, but I'd like to give a little background first, then ask for advice.



I moved into a 5 family house (1 bedroom apartment), in September of 2014. I am a Tenant at will, with no lease. The landlord "doesn't like to do paperwork". I paid a first, last and security deposit equal to one months rent ($1,275). I DID however print out a formal security deposit receipt, and got him to sign it. However, he left the bank account information blank. I am almost 100% certain that he does not keep it in a account as required by law.



Throughout my tenancy my landlord has been unresponsive. In the apartment ad it stated "Free Wifi, Laundry in basement". Neither have come to fruition, I always get the run around. Also, My front door is a 12 pained door, something you'd use for a in house office-not safe, and one of the windows was broken prior to moving in. I repeatedly asked him to replace it with a safer door, no answer. Not that any of that matters to the issue at hand, but just some background.



On November, I left for to go sail down to the Caribbean for two weeks, and got delayed a EXTRA two weeks. I was late on my November rent, and on November 30th I knew I would be behind on December as well. Thus, on November 30th I informed my landlord that December would be my last month of tenancy, I paid Novembers rent a week later. (He only takes cash by the way, no checks).



Anyways, I am almost certain that I will have an issue getting my security deposit back, whether its because he wants to say there are damages to the floor from my dog (scratches from his nails, there are none, one small scratch from the couch). The apartment is in pristine condition. OR He might be impossible to get ahold of. He has no known address, and only a PO Box.



What do you recommend? I'm certain he doesn't have the money in a legal, separate bank account. That right there is grounds to receive the deposit back immediately correct? What is the process for that? I don't want to come on to strong. I'd like to talk to him, do a walkthrough and get his assurances of a quick return of my deposit, but I have the forms and information prepared to give him if he is being difficult. I'm not sure he is even aware of the laws....
