Service Providers: General Termination of a Contract at a Club. Date and Payment Issue

Hi,



I'm terminating my 12-months contract at a gym and having an issue about payment of last month.



My contract is a 12-months contract.

Membership start date: January 8, 2014

Other: 13th month free



As I did start on the 8th I paid the first month pro-rata and my auto payment started on February 1



Relevant information about termination in the terms and conditions of my contract:



"... I am aware that I cannot terminate my membership within the minimum commitment period. To terminate my membership I must give one full calender month's advance notice (such notice to expire on the last day of a month) in person to the Home Club Manager. Notice must be given prior to the month end of the following month to be considered the last month of dues..."



Further:

"... For purposes of these Club Rules, 'one full calendar month' shall means the period from the first day of a given month up to the last day thereof..."





Conclusion

I understand that I have to give notice before end of December to cancel my contract on end on January 31.

But with the 13th month free (keeping in mind that my membership started on January 8 and so also is written down on the contract) do I really have to pay until end of January? Doesn't the 13th month start on January 8, 2015 which then should be free?




They didn't write down that they wouldn't count the January 2014 as first month. There is nowhere written that first month starts on February 1, 2014.



What are you thinking about it?
