My question involves traffic court in the State of: California, Riverside Superior Court
My son received a letter from the court stating he was being fined $497 for failure to appear in court on a 21212(a) citation for failure to wear a helmet when riding a bike, scooter or skateboard. After obtaining a copy of the citation, it was confirmed that someone fraudulently gave the officer my son's name and address (identify fraud) because the description of the person did not match, neither did the date of birth or signature. We have no idea who could have impersonated my son but we'd like to resolve this matter. We requested a new trial date by mail but was denied until we first post the bail fee of $497. I don't have the money and I have proof that this was not my son. School records confirm he was in school at the time and the citation was made at cross streets not on my son's way to school. Also, he does not have a bike, scooter or skateboard and gets ride to school everyday. Please advise!
