My question involves labor and employment Law for the state of: VA
I work as work control in an office which has a lot of traffic from employees, staff, students and faculty. I am 53 years old and have been diagnosed many times through the years with PTSD. The last few months have been hard, to say the least for me. I have witnessed an angry employee burst through the door cussing....saying "I'm so F***ing MAD kicking chairs, inhaling & exhaling very rapidly like he was ready to just go off the deep end. I was alone at the time in the office with him, which really intensified my fear; the director walked in right afterwards, he still exhibited extreme anger, cursing, speaking very loud to the director, who finally took him in his office. The director talked to him. After the employee left, I told the director what happened when he stormed through the door cussing and kicking chairs, he didn't really say much about the incident, he didn't contact HR so a couple days later I took it upon myself to file a grievance with the corporate HR person...I missed 3 days of work waiting to hear back from HR as to whether anything had been done, I was having panic attacks so bad for fear of what he would do to me if he found out that I told the director what had happened. The director finally called and said he didn't think he would do it again and it was fine to come back to work, so I did.
I told the director that a few weeks ago, this same employee was sitting at the table in the office next to my desk bragging to fellow employee how a couple years ago a former employee had made him so mad that he had jumped after from the table, going after that employee telling that him "I WILL KILL YOU!", and that a supervisor had to pull him back away from him. This incident was also with the same employer.
A week later, the same employee, again got mad about something, kicked a few chairs, then left the office. I reported this also to the director. The director has taken no action, nor has the corporate office to stop this behavior. I fear that by them doing nothing they may has well told him that you can do whatever you want, there are no consequences.
The director and HR from the Corporate Office knows that I suffer from PTSD and now twice an outburst has happened in the office. I sat many days, praying that no one will make this employee mad, there are days my heart is racing and I'm just sick at my stomach. I don't know how I would get through witnessing an outburst such as his again.
Last week, a coach from athletics came in furious, he didn't target me but I was sitting there he hollered, yelled, & cussed another employee, who also happens to be a student worker for the University. (The coach works for the University that subcontracts my company for Physical Facilities Maintenance, we are all on the same University property). The girl that he yelled and cussed at , and myself wrote a statement to the University's HR person.
This week on two separate occasions, Monday & Tuesday our housekeeping supervisor starts hollering stomping through the office because a housekeeper asked if she could come in half an hour early in order to have a ride to work because of the bad weather. She start hollering how she was tired of people going over her head, she was going to put a stop to it...just on and on. To me it downright bullying and intimated her employee to the point of tears. There were 4 others in the office at the time, one was a University Student. I have also heard this housekeeping supervisor on numerous occasions make unfounded, biased accusations against an African american employee that we have working for us, her gossip is relentless against him to the point that he has contacted the EEOC, my understanding from him is there is evidence for them to look into the matter.
I have tried to be brief, just writing a basic overview; I am having anxiety attacks again, almost to the point of panic. The director,we have, is new and young and no doubt fears confrontation with any employee. No discipline has been taken; I was told the employee who kicked the chairs would only been in the office to clock in and out...he's in there at least a dozen times a day, sometimes for an hour or more.
I feel his behavior has set a precedence that the employees or supervisors know that this behavior is allowed, so it continues and I fear may escalate to the point of someone getting hurt. These incidents have all taken place since December 22, 2014, now with the supervisor of the housekeeper following the hostile behavior.
I don't know what, if anything, there is that I can do to get the Director to step up I would love to just go to work, and not have to worry or fear what's going to happen today.
