My question involves child support in the State of: New York
Though previous modification order, custodial mom is required to submit form to me (non-custodial dad) to account for daycare expenses for two children (one with special needs). Forms indicate hours of private daycare used (babysitter), provider's name, signature, and phone#. Now it appears that mom is submitting a form to me that has been photocopied with the information of the daycare provider. Also she indicates "cash" payments.
Is a modification my best option to address these concerns that she may be falsifying form and submitting illegitimate expenses?
Backstory: One child was kicked out of summer camp for behavior issues. Mom did not inform me of the fact, or of the sizable refund of summer camp fee. When confronted, she stated she wanted to hold that $ towards other possible expenses... I did not consent and insisted that daycare $ be used for daycare only. (I also pay certain medical & extra-curricular costs under separate direction, and as such, account for those separately as well.)
Further muddying things, she testified in our last proceeding that her position is "itinerant teacher" without a set workday or hours. She provides in-home services to special needs children. How can I verify that she is actually working during times for which she submits daycare expenses? NYS doesn't seem to think of this as a "violation" (apparently only custodial parents can file violations...) So I am unsure how to get this in front of the court to ensure that I am paying legitimate expenses.
