Fences and Walls: Neighbor Removed Our Fence Claiming Its on Their Property

My question involves real estate located in the State of: New Jersey



Our neighbor knocked on our door late one evening to inform us the new buyers for his house wanted him to remove our fence which they claimed was on their property. We told them not to do anything as they didn't show us proof of the fact and the fence was there when we purchased the home five yrs ago. Infact its been there for at least 10 yrs.

I questioned the claim. Either way we got home the following day to find our perfectly functioning fence had been removed. Do I have a right to request proof from them? What can i do legally now that they went ahead without our approval? I didnt even have a chance to go to city hall to dpeak to someone. Now I don't have a fence, its not in my budget to replace it or to get a surveyor to mark the property. And, my small children and dog can not use the back yard now as its a hazard given proximity to a busy street. According to the old neighbor, the new owners want to install a fence when the weather gets better (smh). The New owners have moved in and haven't so much as looked our way. My husband is completely against me knocking on their door until we get advice. I figure communication is the first step between us and our new neighbors even if they failed at it first. I doubt that two identical homes built in the mid forties within ten feet of eachother would afford one property all space in between while blocking the other's access to the yard. My concern is that if indeed this fence was in their property and they decide to build upto the boundary they would be completely blocking our access to the backyard. Can they do this! What can I do? Feeling overwhelmed please inform.
