My question involves a traffic citation from the state of: NY
My girlfriend sold her car and we neglected to remove the registration sticker from the windshield.
The new owners have apparently not transferred the registration to their names; at the very least they haven't changed the registration sticker in the windshield, and they've racked up over 12 NYC traffic violations in the past 3 months, the first being the middle of December, and the most recent one a few weeks ago, so this isn't the end of it yet. The tickets are for expired inspection and parking in a no parking zone (or something like that)
We have pleaded "not guilty- hearing by mail" as per the instructions on the back of the ticket, and have enclosed the buyers name and address, bill of sale, and the DMV receipt for plate surrender which was dated prior to all of the tickets. We've also filled out the DMV form for "unauthorized use of motor vehicle registration". The registration expires this week.
She also left her EZ-Pass in the windshield and the buyers racked up over $100 in tolls before this was discovered and the EZ-Pass was cancelled. Do we have any recourse here?
Yesterday we received a verdict on the first two tickets. The response was "sufficient documentation was provided to proof that registration was transferred" and both tickets were dismissed.
It is of course my hope that even if the remaining tickets are reviewed by a different judicial administrator, the findings will be the same, but you never know.
My question now is, is this just going to continue indefinitely? With the dismissal of the tickets, we're off the hook, but so is the buyer who continues to rack up parking tickets with impunity. I'm going to guess that there is no communication between the traffic court and whoever is responsible for issuing the tickets to the vehicle.
Is there anything else that can be done to end this saga? The precinct serving the tickets was no help, they just said "the car will eventually be impounded due to unpaid tickets" but again, the tickets have been dismissed so how will there be an impound due to unpaid tickets if they keep getting dismissed?
