Presumption of Paternity: Can You Be Required to Take a DNA Test After Someone else Signed an AOP

jeudi 5 février 2015

My question involves paternity law for the State of: SC

I was served with a motion to appear and the mother is asking the courts that I take a DNA test for a child that she already signed an AOP with another guy 8 years ago. We had 1 other child in common but she was TPRed years ago and an adoption took place with my wife. She is now coming back saying the other child is mine as well and is wanting child support dating back to the birth. She is claiming in the motion that she and the guy knew he was not the father but signed any way because he wanted to adopt the child. Do I have a shot at not having to take a DNA test? And having her pay my attorney fees? I want nothing to do with this lady she has abused and negelted my child that she lost through tpr and only wants to further harass us.
