Search and Seizure: Proper "Execution" of a Search Warrant

mercredi 18 février 2015

My question involves criminal law for the state of: IL

My cousin got a visit from local law enforcement last month and we're trying to find out if the police followed protocol for executing a search warrant.

2 questions:

1) Local PD, SWAT, etc. entered through the sunroom in the back of his home. (They opened the sunroom door and entered the sunroom to get to the back door of his home AND then proceeded to knock to notify him they were there. Is entering an attached room without knocking illegal?

2) Local PD did not show proof of search warrant until after SWAT went thru the home and after the detective on the case showed up. (The lead detective on the case is the one who signed the search warrant, but again they showed up last after local PD, SWAT, photog guys).

anything wrong/illegal with how they executed the search warrant?
