Sentencing: Sd Resident, DWI in Mn - Information Regarding License Revocation, Interstate Compact

vendredi 13 février 2015

My question involves criminal law for the state of: MN & SD

MN revoked my license - didn't take it, being I'm a non-resident - but I'm finding conflicting information with regards to whether that means it's invalid only in MN, or also in SD and every other state for that matter?!??

Some say all states, some say only in MN because "it does not have the right to completely revoke your license", but once notified SD can/will based on their statutes?!?!

And to complicate things there's the probable "Interstate Compact" between the two, which doesn't explicitely explain what is done by either in any given situation??!?! Oh...and I've had no luck finding a Lawyer in EITHER state that is willing to provide any sort of definitive answer or information during an initial consultation without first hiring them/giving them retainer $$$!!?!

Hense one reason for my asking here, versus calling someone of course:confused:. . .?!

Another thing is, being as the statutes aren't the same - in MN it's a Gross Misd'r versus a Class 1 Misd'r in SD so the time of revokation, max jail times & fines are all more in MN - there are questions regarding how each state handles all of that also. . .?!??

I thank you in advance! :)

(Note that although I obv'y welcome, and appreciate, input from anyone regarding this, I am mainly seeking that from those whom have pertinant knowledge of each state's laws, practices, and hopefully some experience with just such a situation - being that things vary from state to state. Ty!)
