Adoption of Children: Fl: Involuntary Termination of Parental Rights

My question involves adoption law for the State of: FL



I am looking into terminating my daughter's father's rights. We were never married but he is on the birth certificate. I have read the FL laws and am looking into an attorney. I came across this site and am interested to hear some input as this is a scary process for me.



She is 7 and he has not seen or contacted her in 5 years. Even then it was me contacting him and forcing it. He was only concerned about seeing me. One day after leaving his mom's, where he would come to see "us", his mom emailed me saying she feared for my daughter's life when she was there and she would rather she not come back. When I left he had started doing drugs and was becoming very angry and violent. After I left he made threats to kill me and make sure nobody knew



I ended up filing for a restraining order about a year later after him and girlfriend at the time started calling me in the middle of the night threatening to hurt me and my child. This got denied because he couldnt be found to be served. At this time and until present he spents more time in jail then out for battery, usually on girls 2 of which have been pregnant, drugs, and possession of a firearm. Most recently with a felony for habitual violent charges.



A child support order has been in place since I left him but the only time anything is paid is when he is arrested for it and has to pay to get out which was over 2 years ago.



I am married and my husband would like to adopt her, he is her father in her eyes. The problem is the father is dangerous and will not just sign over his rights because he likes to make life miserable.



Do I seem to have a fairly good case? I am so scared he is going to flip out when we do this. I would appreciate any input. Thank you.
