My question involves a child custody case from the State of: New York
My relationship with my son's father has past domestic violence and I decided to end things 4 years ago. Afterwards we had visitation established for Saturdays and things were going well until a few months later, he ended up in jail for harassment and served his time (he was in and out of jail prior to this). He got out of jail in March 2012 and did not wish to see my son. I reached out several times only to learn he had been kicked out of his parents out and moved to a grandparents house. Since he does not have his license his family had refused to take my son there and had told me he just didn't want to see him. Since then, I have seen him in public with my son with me, he has harassed my husband (not about wanting to see him but bothered because he settled down with me) and still did not ask about the welfare of my child at all. I learned he has spent several months in and out of jail for multiple felonies. This summer he met a girl who has 3 kids of her own. She wrote out another petition for him to reestablish visitation. She contacted me impersonating a lawyer and improperly served court papers. My lawyer went to the first appearance for me and says his defense is that he could not locate me, which is ridiculous because they improperly served the papers to my mother's house, harassed my husband and I throughout social media and I did not change my number this entire time. His girlfriend has been the only one reaching out with threatening notes in the mail but I have not been reached out by him personally so my lawyer advised me not to contact her, she is not involved in the case at all. I explained this in further detail with my son's appointed lawyer and they understand my concern but did not give me further information. I'm unsure what will result in all of this with the situation that surrounds it. Our counter petition is for my husband to go forth and adopt my son so we can finally stop this cycle that is detrimental for my son as he has no idea who his biological father is.
What is the likelihood of establishing adoption considering the background? Obviously this is all a gist of the overall issue and I can explain anything further if anyone has questions.
