Custody and Visitation Issues: Can a Non-Custodial Parent Sue Over Alleged Denial of Access

My question involves a child custody case from the State of: WA and AR



Biological father and mother split when the daughter was 2 weeks old. I, mother, became aware of his drug use and suffered abuse. Bio threatened to take daughter. However, he was not on the AR birth certificate.



I moved with my daughter to WA when she was 3 months old. Biological called a handful of times to start and threatened to sue for kidnapping, but not on birth certificate so nothing he could do. I filed his name on the birth certificate (had a signed/notarized aff. of paternity) so I could change her last name and file child support with the state of WA, AFTER we'd been living there for a few months.



Heard from him once or twice, normally when he was strung on drugs. Then haven't heard a word after she was 2.5 yrs old. She does not know him but knows of him.



She's 7 now and my fiancé wants to adopt her. Yay! But my ex has threatened to fight. He also said he's going to take me to civil to claim he was "denied the opportunity to know and establish a relationship with his child" because I moved to WA state.



NOTE: I've never received child support of any kind, we were never married nor had custody plan, he made no attempts to contact even though I have the same number and address all this time, I have proof he OD'd on illegal drugs and almost died seven months ago, he has no job and still lives with his parents...almost 30. I have a great paying job, so does my fiancé, we are stable and provide a wonderfully spoiled home for my daughter.



Can he sue for this? Also, what are the chances he will win? Finally, am I assuming correct that I would have to go to Arkansas if that's where he files the civil case?
