Drunk and Impaired Driving: Will I Have to Serve Jail Time

mardi 2 septembre 2014

My question involves criminal law for the state of: California

Hello,

I was recently arrested for a DUI. I have two prior wet and reckless charges on my record from 2005. Both wet and reckless charges were when I was under the legal drinking age of 21. The first one My BAC was far below .08, my second was above and was driving in a suspended license. Now I am of age, and received a DUI, some 9 years later. My questions are as flows:

1) Is there a good chance I will have to serve jail time? If so for up to how long?

2) Considering the fact I have had no further incidents since this time, will that assist me in any way when the judge reviews my case?

3) Should I look into getting a lawyer to assist me?

4) Is there a good chance I will lose my license and not be eligible for a provisional license to drive to and from work? I have a house where I have to pay rent and a job I have been at for 3 years. I am concerned I will lose both.

Thank you, I am ver concerned about this and look forward to hopefully getting some answers.
