My question involves a power of attorney in the state of: Texas
My father has alzheimers and my mom has POA (Durable General POA). My dad has primary POA for mom's documents, but he can not make decisions. I am the alternate POA on both my mom and dad's documents. My father has an annuity with mom as a joint owner. We are trying to move the annuity to a irrevocable trust that was established. I am the executor of the trust. My Mom has tried unsuccessfully four times to fill out the required paperwork. Long story, but this has been going on for six months.
What is the most efficient way to complete this? The financial institution will not even answer general questions about the process since I am not the primary POA. Since mom and dad are both on the annuity account, do they both need to temporarily delegate their POA to me so I can complete all the paperwork? To accomplish this, I assume a new POA is written, signed, notorized, etc. After the account is moved, I assume another POA can be completed so Mom remains the POA for Dad.
