Heirs and Beneficiaries: Death of Ex-Spouse with Minor Child Heir

dimanche 7 septembre 2014

My question involves estate proceedings in the state of: Florida

background:

My ex-husband passed away last week unexpectedly at the age of 38. Our 12 year old daughter was his only child. I have a very rocky relationship with his family; parents and brothers so I have no idea of knowing what his will stated, though a few years ago he stated that 75% of his estate would go to our daughter and the remaining 25% will be split between his siblings. In our separation / parenting agreement that was signed about 2 years ago, we both agreed to take out life insurance policies with the other party being named beneficiary. I have a 150,000 policy and he was supposed to have a 250,000 policy. I have absolutely no idea if he ever took out his policy.

My questions:

What can I do to protect my daughters interests with regards to his estate?

Do I need to hire an attorney?

How would I find out if he did have a life insurance policy?

If he did not take out a policy, can I recover the amount from the estate?

I don't want to approach his family just yet, it's a bit to soon. I thought I'd ask here to see if anyone had some general advice.

Thanks

Jennifer
