My question involves a driver's license issued by the State of: New Jersey.
My license was suspended around 5 months ago for not paying an insurance surcharge on some points I racked up when I was 17-18 (I'm now 24.). I was not aware of this suspension because my father has the same name as me and intercepted the mail, thinking it was for him, but never opened the notice. He is also a diabetic on kidney dialysis, and is nearly blind. I'm also aware this is not an "excuse" per se. But it is the truth.
A month after suspension, I was involved in an auto accident. It was nothing serious and I wasn't at fault. This occurred under suspension, but I still wasn't aware. The police who arrived on scene to mediate the accident did NOT let me know of the suspension NOR did I receive a ticket.
A couple weeks pass and I eventually find the notice of suspension and IMMEDIATELY have someone drive me to the DMV to pay it off.
At the end of June, I received a notice in the mail stating that my license was to be suspended for 180 days because I was involved in the accident while my license was suspended.
I'm scheduled for a court date in Trenton in two short weeks. I've paid my dues and fines as soon as I "saw" the notice. How should I go about handling this? Should I obtain a lawyer? Should I represent myself and be honest and sincere with the judge? Any help would be greatly appreciated as I need to drive to live. Thank you very much!
